THE REAL ESTATE COMMISSION

It is often asked, "Who pays the real estate commission in a traditional real estate transaction?". The correct question should be: WHAT actually pays the commission, not who. The answer is “Real estate commissions are paid from the contract price as determined from the buyer and seller's negotiations.”

In a traditional real estate (sub-agency) situation, both real estate broker's commissions are included in the purchase price. The commission is paid from the contract purchase price and disbursed at the time of settlement. The commission goes to pay the two real estate brokers who represented the seller. A diagram best illustrates the flow of the commission in the normal method.

The traditional method shown above legally eliminates the buyer from having agency representation. The cash flows from the buyer to the seller and then a portion to the seller's agent and in most cases, to his sub-agent. But the buyer has had nothing to say about the amount, nor has be been given "the whole story".

Buyer Brokerage offers an alternative to each real estate buyer at no additional cost to either party. A buyer, once he negotiates a purchase or even before, can now have a voice in the flow and the amount of the dollars and more importantly, have his own representation and all of the trust, loyalty and confidence usually reserved for the seller.

Buyer Brokerage. As you can see below, both parties legally receive agency representation.


Remember, Mr. and Mrs. Real Estate Buyer, that two real estate companies will be paid by the money that you bring to the closing table anyway... companies that do not legally represent you!
